How client papers are kept

This notice explains how Mind Anchor Analytics Co., Ltd. handles personal data. The practice is the data controller for inquiries and for the administrative file of a commission. For personal data inside questionnaires that a client sends us, the client is usually the controller and we handle those materials on the client’s instructions for the commission only.

What we collect

From the inquiry form and from letters: your name, email address, the commission you are considering, an approximate count of returned forms, a preferred sitting date, the language of the questionnaire, and the message you write. From a commission: the questionnaires, comment cards, tallies, draft folios, invoices, and correspondence. We do not ask for identity card numbers, payment card numbers on this website, or health records.

If a customer’s comment names a person, we lift the name out of the folio. The original card may still contain it until the retention period ends and the packet is destroyed.

Why we use it

We use inquiry details to reply, to estimate a fee, and to keep a record of what was agreed. We use survey materials to perform the commission you booked. The lawful bases we rely on are steps toward a contract, performance of a contract, and our legitimate interest in keeping an accurate file of the work, and, where a Thai legal duty applies, compliance with that duty. We do not sell personal data and we do not use questionnaire comments to advertise to the people who wrote them.

Retention

Inquiry letters that do not become a commission are kept for 24 months and then deleted. Commission files, including questionnaires and the folio, are kept for 18 months after the sitting or after delivery of a drafted form, then destroyed, unless you ask for earlier destruction in writing or a Thai law requires a longer hold for invoices. Invoices and payment records are kept for the period Thai tax rules require, separate from the comment cards.

Your rights

Under the Personal Data Protection Act of Thailand you may ask to access the personal data we hold about you, to correct it, to delete it, to restrict its use, to object to certain uses, and to receive a portable copy where the law provides that right. You may withdraw consent where processing was based on consent, without affecting earlier lawful processing. You may lodge a complaint with the Personal Data Protection Committee. We may need to confirm you are the person the data is about before we act. We aim to answer within 30 days.

If you are a customer who wrote on a client’s questionnaire, send your request to that organisation first. If you write to us, we will refer the request to the client who supplied the card, unless we are required to answer you directly.

International transfers

Survey materials are read and stored at our office in Bangkok. We do not appoint a foreign processor to analyse them and we do not move the packet to a server outside Thailand for that purpose. If you email materials to us, the path those messages take depends on your mail provider and ours, and may pass through other countries in transit. That transit is a consequence of email, not a transfer we arrange for analysis. Typefaces on this website are requested from Google Fonts; that request does not include your questionnaire.

Sharing

We share personal data with a translator only when you have arranged one, with our bank when an invoice is paid, and with an authority if Thai law requires it. Staff of the practice who read a pile are bound to keep it inside the commission.

The cookie notice is on the cookies page. Rejecting optional storage does not limit your use of the site or your ability to send an inquiry.
