Terms of engagement

These terms govern commissions agreed with Mind Anchor Analytics Co., Ltd. (“the practice”), registered in Bangkok and working from 59/143/1 Moo 5 Nimitrmai Road, East Samwa, Khlong Sam Wa, Bangkok 10510. By sending an inquiry, paying a deposit, or delivering survey materials, you agree to these terms together with the letter of engagement for that commission and the refund terms.

Acceptance

A commission begins when we confirm it in writing and receive the deposit stated in the letter. A page on this website describes the usual shape of the work; the letter states the actual pile, languages, dates, and fee. If the two differ, the letter prevails. You confirm that you have authority to share the questionnaires and to bind the organisation that will pay.

The work

We read or draft customer questionnaires as described in the commission you booked: a Survey Insight Briefing, a Questionnaire Commission, a Verbatim Comment Reading, or a Year-beside-Year Reading. The result is a folio, a form, a field note, a sitting, or a combination named in the letter. We do not collect responses at your desk unless a separate written arrangement says so, and that arrangement is not part of the standard fees.

Findings describe patterns in the materials you supply. They are not a legal opinion, a clinical judgement, an audit, or a promise about revenue, enrolment, or reputation. You remain responsible for decisions taken after the sitting.

Your materials

You warrant that you may lawfully share the questionnaires and any personal data in them, and that staff and customers were told what they needed to be told under the law that applies to you. You will not send national identity numbers or medical records. If such data appears, we may delete it and pause the commission until the packet is cleaned.

Intellectual property

You keep ownership of your questionnaires, your tallies, and the comments your customers wrote. The practice owns the wording of its written reading and the drawn plates until the balance of the fee is paid. On payment in full you receive a licence to use the folio inside your organisation, to show it to your board, and to keep copies for your records. You may not sell the folio, publish it as a specimen of method, or remove the practice’s name from a copy you circulate outside your organisation, without written consent.

We may describe a commission in general terms (an inn in Bang Rak, a market form) only with your permission, and never with customer names or unpublished figures. Field notes on this website are written from experience and do not reproduce a client’s folio.

Fees

Fees are informational on the website and binding only in a letter of engagement. A deposit of forty percent is due before work starts. The balance is due before the sitting or on delivery of a drafted questionnaire. Late payment may pause a sitting. We may stop and re-quote if the pile is materially larger than you described.

Liability

We will carry out the commission with reasonable care. If we miss a deadline because the packet was incomplete, the time shifts by the days we waited. Our total liability arising out of a commission is limited to the fees you paid for that commission, except where Thai law does not allow a limit, including liability for fraud or for death or personal injury caused by our negligence. We are not liable for decisions you make after a sitting, for loss of profit, or for a result you hoped the answers would show and they did not.

Governing law

These terms are governed by the laws of Thailand. The courts of Bangkok have jurisdiction, without prejudice to any mandatory right you have as a consumer under Thai law. If a clause is held unenforceable, the rest remains in force.
